Ex-Baylor Elliott indicted in Texas assault case

WACO, Texas (AP) Former Baylor defensive end Tevin Elliott has been indicted on three counts of sexual assault.

A McLennan County grand jury indicted Elliott on Monday.

Investigators say two counts refer to an alleged assault at an April 15 party in Waco. The Waco Tribune-Herald (http://bit.ly/PXU4CY ) reports that details of the other count are sealed because Elliott has not been arrested in that case.

Baylor suspended Elliott April 27 for unspecified team violations. He was charged with sexual assault April 30 and freed on $10,000 bond.

Elliott's attorney, Jason Darling, says the allegations are untrue and the April 15 sexual encounter was consensual. Darling knows nothing about the third count.

Elliott had 63 tackles and eight sacks in two seasons with Baylor. He since transferred to Central Arkansas.
